This Act is derived from Part 5 (whistleblower protection) of the Open Democracy Bill [B67 - 98], which Part was omitted from that Bill to be dealt with as a separate Act.
The Act makes provision for procedures in terms of which employees in both the public and private sector may disclose information regarding unlawful or irregular conduct by their employers or other employees. The Act provides for the protection of employees from being subjected to an occupational detriment on account of having made a disclosure which is protected in terms of the Act.
