SO WHAT DOES THE EMPLOYMENT EQUITY ACT REQUIRE?
In terms of Section 23 of the Employment Equity Act, the Act requires that: “Before the end of the term of its current employment equity plan, a designated employer must prepare a subsequent employment equity plan”,
WHAT IS A DESIGNATED EMPLOYER?
A designated employer is any employer employing 50 or more employees or who has a total annual turnover as reflected in Schedule 4 of the Employment Equity Act.
Muncipalities as well as organs of state are included. Employers can further also volunteer to become a designated employer.
WHAT EXACTLY DOES ALL OF THIS MEAN?
Practically what this is telling us is that in order to successfully pass an Employment Equity Act Inspection by the Department of Labour, you will be required to have both the initial as well as a subsequent Employment Equity Succession Plan in place and implemented in your workplace.
The Act further empowers the Director General to conduct a review of any designated employer to determine compliance. The Director General may request submission of the current analysis, the Employment Equity plan or any relevant information. The Director General may also request a meeting with the employer or any stakeholder to discuss its Employment Equity plan and the implementation thereof.
WHAT ARE THE IMPLICATIONS?
Since the legislation was promulgated in 1999, employers have had the opportunity to prepare and implement their equity plans. These plans must clearly state the affirmative action plan, and annual objectives. Among the aspects of the Regulations that the blitz inspections will be focusing on is whether or not employers have:
- Submitted their equity reports as per the deadline;
- The existence of representative employment equity forums at their workplace;
- Levels of awareness among employees on equity matters; and
- Employers’ general compliance.
Speaking about the Director-General Review process under Section 43 of the Employment Equity Act, James Molane, of the Employment Equity section, said employers in the private and public sector would be investigated for compliance with the Act.
